Unauthorized Transactions
PalmFit is not responsible for any loss incurred due to:
Non-sufficient funds, returned checks, chargebacks, claims, reversals, or any associated fees.
Early funding fees, account maintenance fees, excessive return fees, or unforeseen unsuccessful transactions.
If PalmFit identifies a fraudulent, erroneous, or duplicate transaction, or receives a chargeback or reversal from a User’s credit card company or bank, PalmFit reserves the right to:
Seek reimbursement from the User by charging the User’s account or credit card, deducting amounts from future transfers, or employing a third-party collection agency.
Terminate the User’s account for failure to comply with reimbursement obligations.
Currency
PalmFit operates in AED, GBP, and USD.
PalmFit is not responsible for currency fluctuations during transactions or billing in currencies other than AED.
Intellectual Property Rights
All content on the PalmFit platform, including text, images, videos, and design, is owned by PalmFit or its licensors. You may:
Temporarily store content on your device.
Print or download one copy for personal, non-commercial use.
You may not:
Modify, distribute, reproduce, or create derivative works from any platform materials.
Remove copyright, trademark, or proprietary rights notices.
Unauthorized use of platform content will result in termination of your access and potential legal action.
Trademarks
The PalmFit name, logo, and related trademarks may not be used without written permission from PalmFit.
Prohibited Uses
You agree to use the platform only for lawful purposes and not to:
Violate local or international laws.
Send spam, impersonate others, or engage in fraudulent activities.
Interfere with platform functionality or introduce harmful code.
PalmFit reserves the right to investigate, refuse transactions, and take legal action against prohibited activities.
User Content
Users retain ownership of their content but grant PalmFit a license to store, copy, and use it as necessary to provide services. User Content must comply with these Terms, and PalmFit reserves the right to remove content that violates policies.
Monitoring & Enforcement
PalmFit has the right to:
Suspend or terminate User accounts for any violation of these Terms.
Cooperate with law enforcement regarding unlawful activities. PalmFit is not liable for any objectionable content posted by users but will act promptly to remove such content when notified.
Disclaimer of Warranties
The platform and its content are provided “as is” and “as available” without warranties of any kind.
PalmFit disclaims all warranties, including merchantability, non-infringement, and fitness for a particular purpose.
Limitation of Liability
PalmFit’s total liability is limited to AED 10,000.
PalmFit is not liable for indirect, incidental, or consequential damages, including but not limited to:
Loss of revenue or data.
Emotional distress or personal injury.
Indemnification
You agree to indemnify and hold harmless PalmFit and its affiliates from any claims, damages, or losses arising from your use of the platform or violation of these Terms.
Waiver & Severability
Failure by PalmFit to enforce any term does not constitute a waiver.
If any provision is deemed invalid, the remaining terms remain in effect.
Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between PalmFit and the User, superseding prior agreements.
